Copyright License for Stock Photos & Images

Ⓒ Copyright 2018, Jess Stryker.
Creative Commons License
The Free Stock Photos & Images on this website (JessStryker.com) by Jess Stryker are licensed under a Creative Commons Attribution 4.0 International License.

Summary of Copyright License Requirements

This is a human-readable summary of  the license.  It is not the actual license, and is not a substitute for the license.

You are free to:
  • Share — copy and redistribute the photos & images in any medium or format.
  • Adapt — remix, transform, and build upon the photos & images for any purpose, even commercially.
The following Terms/Conditions Apply:
  • Attribution — Not required for most uses*.  You must give appropriate credit if you post a copy of the photo/image on a photo sharing site (such as Instagram, Flickr, Photobucket, etc.,) a stock photo site, or any other website or system that primarily distributes photos.  You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.
    * See the section titled "Additional Permissions" below for more information.
  • No additional restrictions — You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.
  • No warranties are given. The license may not give you all of the permissions necessary for your intended use. For example, other rights such as publicity, privacy, or moral rights may limit how you use the material.
Disclaimer
The above text highlights only some of the key features and terms of the actual license. It is not a license and has no legal value. You should carefully review all of the terms and conditions of the actual license before using the licensed material.   See the actual license here: Creative Commons Attribution 4.0 International License (CC-BY-4.0).

Note that only the photos and images are licensed for your use.  Other features of this website, such as all text (including photo descriptions), headings, logos, and the website layout, have a separate copyright and are NOT available for your use under this license.  In other words, you may not copy this website.  The website text and layout are Ⓒ Copyright 2018, Jess Stryker. All rights reserved.

The purpose of these copyrights and the license is to try to give you as much freedom as possible to use the photos and images for creative purposes, while discouraging those that would take the unmodified images and distribute them as stock photos on a competing website.

What is Attribution?

Attribution is displaying who owns the copyright on the photo or image.  The minimum attribution to use on photos and images is this:
Ⓒ Copyright (add year here*), Jess Stryker.
For posting in stock photo collections you must also include the following license information:
Creative Commons License

Based on a work at https://www.jessstryker.com/.
Permissions beyond the scope of this license may be available at http://jessstryker.blogspot.com/p/copyright-license.html.

*Note: The year to use is noted below each actual photo on this website.

Summary of Additional Permissions:

These Additional Permissions give you other rights, subject to conditions, beyond those granted by the Creative Commons Attribution 4.0 International License.
Attribution is not required for most uses. You may always provide attribution if you like and it is really appreciated when you do!

Attribution IS REQUIRED for posting or distribution of the images or photos on stock photo or other photo sharing and distributing platforms, regardless of whether the images or photos are offered free or for sale.  (That means attribution is required if posted on Pinterest, SmugMug, Flickr, PhotoBucket, SnapFish, etc.)  If you post our photos or images on a website that primarily features photos for download it must be attributed.

Examples:

Attribution is required (show the copyright info):
  • Posting the image or photo on a website that consists mostly of photos.  If you're not sure, provide the attribution!  Posting in any collection of stock photos requires full attribution including the use license!  This applies even if the photos are offered free.
  • Posting the image or photo on a photo-sharing website or app, that is simply a collection of photos.  If the site visually looks like a photo album you probably need to provide the attribution.
No attribution required:
  • A painting based on one of our photos is a derivative work that is substantially different, so it does not require attribution.  Same for a collage, or if the photo is used as a background image or in some other way incorporated into a new material.  Print it on a T-shirt for example.  So if you have modified the image (just changing the size doesn't count as a modification) attribution is not required.
  • One of our photos used as an illustration to go along with a written article, like in a newspaper, magazine, blog (both online or print,) would not require attribution.  Keep in mind that ethical standards call for a simple single line copyright notice with date and name to appear below the photo.  So if you want to look professional, use a simple copyright notice.
  • One of our photos/images used in a school report would not require attribution.  However, your instructor probably DOES require that you provide attribution in a footnote and/or bibliography, as that is the standard for good scholarship!

Text of the Additional Permissions Legal Agreement:

In reference to the "Creative Commons Attribution 4.0 International Public License" agreement:
Section 3 - "License Conditions", Subsection a, "Attribution", is waived for derivative works provided they are noticeably different in appearance.  A change in size only is not a derivative work for purposes of this agreement.
Section 3 - "License Conditions", Subsection a, "Attribution", is waived provided You do NOT offer the Licensed Material primarily as a file for download, publish it on a photo sharing website or app, or distribute the Licensed Material as a stock image or stock photo, alone or in a package or collection.  This applies if the Licensed Material is offered free or offered for sale.
All other terms and conditions of the Creative Commons Attribution 4.0 International License remain.
